DMCA Policy for Apple Mac Book Neo
Apple Mac Book Neo is committed to complying with U.S. copyright law and expects its users to do the same. This DMCA Policy describes our procedures for addressing alleged copyright infringement under the Digital Millennium Copyright Act (DMCA).
We respect the intellectual property rights of others and respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Apple Mac Book Neo service, please notify our Copyright Agent as set forth below.
Filing a DMCA Notice of Alleged Infringement
If you are a copyright owner or an agent thereof and believe that any content hosted on or linked to by Apple Mac Book Neo infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing (please consult your legal counsel or see 17 U.S.C. Section 512(c)(3) to confirm these requirements):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Apple Mac Book Neo to locate the material (e.g., a URL link).
- Information reasonably sufficient to permit Apple Mac Book Neo to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of a valid DMCA notice, we will investigate the claim and take appropriate action, which may include removing or disabling access to the infringing material. We may also notify the alleged infringer of your claim.
Filing a DMCA Counter-Notification
If you believe that your content was removed or access to it was disabled by mistake or misidentification, you have the right to submit a Counter-Notification. To do so, please provide our Copyright Agent with the following information in writing (please consult your legal counsel or see 17 U.S.C. Section 512(g)(3) to confirm these requirements):
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Apple Mac Book Neo may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
Upon receipt of a valid Counter-Notification, we will forward a copy to the original complaining party and inform them that we will restore the removed material or cease disabling access to it in 10 business days, unless we receive notice from the original complaining party that they have filed an action seeking a court order to restrain you from engaging in infringing activity related to the material on our service.
